Ch13online.com Subscriber Agreement

  • Changes to Subscriber Agreement. Bankruptcy Press, Inc. (BPI) may make reasonable changes to this Agreement at any time by notifying you of the change in writing or electronically including by email or by posting a notice on Ch13online.com that terms have been changed. The changes will appear in this document, which you can access at any time by going to the Help section of Ch13online.com. Your assent to be bound by this Agreement includes that you agree to be bound by future changes if you use Ch13online.com after changes are made to this Agreement.
  • Privacy and Your Account.
    • We do not sell, trade or allow others to use your registration data or any other information we learn about you from your use of Ch13online.com.
    • Your information may be stored and processed anywhere Bankruptcy Press, Inc. has facilities, and by subscribing to Ch13online.com, you consent to the transfer of information to any of these facilities for use by us only in providing services to you.
    • If your access to Ch13online.com has been provided by or through a Third Party (for example, your law office, your employer or an educational institution) that Third Party may have provided us with information about you to enable us to provide you with access to Ch13online.com and distinguish you from other subscribers (such as your email address or name). We treat such Third Party information with the same privacy as information received directly from a subscriber.
    • If you access Ch13online.com using a password, you are solely responsible for maintaining the confidentiality of that password. If you provide someone else with access to your password to Ch13online.com, they will have the ability to view confidential information about your account and to make changes through the website for access to Ch13online.com. Similarly, if you tell someone the answer to your security question for Ch13online.com, they will be able to request information about your account and make changes through Subscriber Services. If you believe someone has or can access Ch13online.com using your user name and password without your authorization, notify us immediately.
    • You agree to notify us promptly if you change your address or email so we can continue to contact you and send any notices required hereunder. If you fail to notify us promptly of a change, then any notice we send to your old address or email shall be deemed sufficient notice.
  • Cost.
    • Sample sections of Ch13online.com will be posted on our website from time to time. There is never any cost for accessing these sample sections.
    • The cost of your subscription is listed in the subscriber box on our homepage at Ch13online.com. When your subscription period is over, your password will expire and you will be blocked from access to Ch13online.com until you have re-subscribed through that page. We may not change the fees and charges in effect until your subscription period is over, but they may change at renewal. You are responsible for any additional fees or charges incurred to access Ch13online.com through an internet access provider or other third-party service.
  • Renewal. Your subscription will NOT renew automatically. At the end of your subscription period, access to Ch13online.com will be denied until you resubscribe. We will provide notice in advance of expiration to allow uninterrupted resubscription.
  • Cancellations.
    • Because we provide sample sections of Ch13online.com at no cost, we limit cancellations and refunds after you subscribe.
    • Once you have subscribed,
      • a monthly subscription may not be cancelled.
      • a yearly subscription may be cancelled during the first three months as follows:
        • If you received, as part of your subscription, a USB drive or other media with a static version of any product of Ch13online.com, it must be returned. No refund will be made until the USB drive or other media is received by Bankruptcy Press.
        • For purposes of refunds, the subscription will be converted to the monthly rate, and that amount times the number of months since the subscription began will be subtracted from the refund amount during the first three months of the subscription. For example, if the subscription price was $960 and the monthly rate was $240, and one month of the subscription was used, $240 would be subtracted from the yearly subscription cost and $720 would be refunded; if two months of the subscription were used, $480 would be subtracted and the balance of $480 would be refunded. If three months were used, $240 would be refunded. If more than three months of the service has been used, no refund will be made, but access would be allowed for the complete subscription year.
  • Limitations on Use.
    • This is the most complicated part of this agreement because it is the part where you as a Subscriber make promises to limit who you allow to use your access to Ch13online.com. The principle is this: If you purchase a subscription to Ch13online.com, you will receive 5 user IDs and passwords to Ch13online.com. They may only be shared among FIVE RELATED INDIVIDUALS within an eligible ORGANIZATION. If you want to authorize more than FIVE RELATED INDIVIDUALS to use Ch13online.com, you agree to purchase the appropriate number of additional subscriptions.
      • RELATED INDIVIDUALS means the physical persons who are direct owners, members, and/or employees of an ORGANIZATION that can be a subscriber.
      • ORGANIZATION means a law firm, a law office or a trustee’s office – without regard to the form in which it is organized. ORGANIZATION also means any entity that participates in any way in Chapter 13 cases, either on its own account or as a representative or agent for others – again, without regard to the form in which it is organized.
      • ORGANIZATION does not include any entity organized in any form to share a subscription to Ch13online.com.
      • ORGANIZATION does not include Judges’ chambers, any governmental entity or office, public libraries or libraries at an educational institution, Law Schools or other educational institutions, bar associations or trade associations. SPECIAL SUBSCRIPTION RULES for these entities are only available by contacting Bankruptcy Press, Inc.
      • Except (i) as provided above, and (ii) that the purchaser of a subscription may change at any time the Related Individuals who receive access under that purchaser's subscription, no subscriber may share her subscription with or transfer her subscription to any other person or entity.
    • The text, graphics, images, video, metadata, design, organization, compilation, look and feel, advertising and all other protectable intellectual property (the "Content") available through Ch13online.com are the property of Ch13online.com, Bankruptcy Press,Inc. and Keith M. Lundin. They are protected by copyright and other intellectual property laws. Unless you have our written consent, you may not sell, publish, distribute, retransmit or otherwise provide access to the Content received through Ch13online.com to anyone, with the following exceptions:
      • You may print sections of Ch13online.com as allowed by the control box.
      • If you wish to distribute a copy of an article, or a portion of an article, from Ch13online.com in any form to a few individuals without charge, please contact us. We liberally allow such limited use.
      • You may copy and paste portions of Ch13online.com for use in legal opinions, memoranda, briefs or the like. The correct citation formats will display on each page, and must be used.
      • You may NOT download or store any portion of Ch13online.com on any computer, except for portions copied and inserted into legal documents.
    • You agree not to create abstracts from, copy or display our content for use on another web site or service. You agree not to post any content from Ch13online.com to blogs, newsgroups, mail lists or electronic bulletin boards, without our written consent.
    • You agree not to use Ch13online.com for any unlawful purpose. We reserve the right to terminate or restrict your access to Ch13online.com if, in our opinion, your use might violate any laws, regulations or rulings, infringe upon another person's rights or violate the terms of this Agreement. We may refuse to grant you a user name that impersonates someone else, is protected by trademark or other proprietary right law, or is vulgar or offensive.
    • If you violate any limitation of use, we may cancel the subscription without refund and block all access to Ch13online.com. In addition, we may seek other remedies for violation of our Copyright, including statutory damages and attorney fees.
  • Third Party Web Sites, Services and Software. We may link to, or promote, web sites or services from other entities or offer you the ability to download software from others. You agree that we are not responsible for, and do not control, those web sites, services and software.
  • DISCLAIMERS OF WARRANTIES AND LIMITATIONS ON LIABILITY.
    • You agree that your access to, and use of, Ch13online.com and the content available through Ch13online.com is on an "as-is, as available" basis and we specifically disclaim any representations or warranties, express or implied, including, without limitation, any representations or warranties of merchantability or fitness for a particular purpose.
    • WE DO NOT PROVIDE LEGAL ADVICE; THE CONTENTS OF Ch13online.com ARE THE OPINIONS OF THE AUTHORS AND ARE NOT LEGAL ADVICE.
  • General. This Agreement contains the entire agreement between you and Bankruptcy Press, Inc. regarding your use of Ch13online.com. This Agreement is personal to you, which means that you may not assign your rights or obligations under this Agreement to anyone. You agree that this Agreement, as well as any and all claims arising from this Agreement will be governed by and construed in accordance with the laws of the State of Tennessee. The sole jurisdiction and venue for any litigation arising out of this Agreement will be an appropriate federal or state court located in Tennessee. This Agreement will not be governed by the United Nations Convention on Contracts for the International Sale of Goods.
  • Cookies. We employ cookie technology. If you have disabled cookies as part of the set-up of your internet browser, some parts of our website, including the ability to remember you and your user name and password, may be disabled.
  • Maintenance and Upkeep. From time to time, Ch13online.com will be unavailable for brief periods to enable us to do maintenance and to update content. We will always endeavor to confine such periods to minimize disruption of your use. We cannot offer discounts or extensions for minor interruptions of service for maintenance or upkeep. Any major interruptions of service for which we are responsible will be compensated for by an extension of your existing subscription for an appropriate period.
